GMO Internet asked the Japanese government to act after an attack on its cloud service put customers’ trading accounts at risk. Day 1 explained what the government might be able to do to a computer used in an attack. But does Japan’s new law allow such action in a case like GMO’s?

In 2025, Japan passed the Cyber Response Capability Strengthening Act. Its main aim is to prevent serious cyberattacks on important computer systems, especially those used by the government and critical infrastructure such as essential public services. GMO’s affected service is a private cloud service, rather than an essential public service. Does that put its case outside the law? Not necessarily.

Another law passed at the same time amended the Police Duties Execution Act—the law that sets out what police officers may do to protect people and prevent crime. The amendment allows specially trained officers to access a computer used in an attack over the internet and take steps to stop the attack. This power is not limited to attacks on critical infrastructure. Officers may use it only if they find communications or computer records linked to an attack and conclude that doing nothing would create an urgent risk of serious harm to people’s lives, physical safety, or property. GMO has reported unauthorized trading activity, so harm to property is a concern. Whether the case meets the full legal threshold has not been made public.

If the conditions are met, the police may tell the administrator of a computer used in the attack to take necessary steps, or they may intervene directly. The Self-Defense Forces can join the police only under narrower conditions involving certain important systems and highly organized attacks from abroad. But identifying the right computer matters. It might belong to a small business whose server an attacker has secretly taken over.

Suppose officers could stop that server from sending harmful commands. Removing one program might do the job; shutting down the whole server might also interrupt the business’s normal service. The response must be proportionate to the danger. Before officers act, the Cyber Communications Information Oversight Commission, an independent body set up to review these government measures, normally gives prior approval. There is an exception when there is no time to wait, but officers must report the action to the commission afterward. They must generally notify the server’s administrator as well. A server abroad requires further care: national police officers must consult Japan’s foreign minister because another country’s sovereignty may be involved.

GMO can provide records of the attack and the harm reported by its customers. Those records may help investigators identify an outside computer and assess what danger remains. The authorities must then determine whether acting on that computer would prevent serious harm and satisfy the law’s conditions. That decision depends on evidence about the threat still to come, as well as the damage already done.

Vocabulary

  1. critical infrastructure — services and facilities essential to society, such as electricity, water, and transport. Example: An attack on critical infrastructure could disrupt daily life for many people.
  2. set out — to state or explain something clearly, especially rules, plans, or duties. Example: The law sets out what police officers may do in certain situations.
  3. urgent — needing action quickly because waiting could cause harm. Example: Officers must consider whether there is an urgent risk of further damage.
  4. threshold — the level or conditions that must be reached before something can happen. Example: A serious financial loss does not automatically meet the legal threshold for intervention.
  5. intervene — to become involved in a situation in order to change or stop what is happening. Example: The police may intervene directly if the legal conditions are met.
  6. proportionate — no more extensive or harmful than is necessary for a particular purpose. Example: Removing one harmful program may be more proportionate than shutting down the entire server.
  7. prior approval — official permission given before an action takes place. Example: The operation normally requires prior approval from an independent commission.
  8. notify — to formally tell someone about something. Example: Officers must generally notify the server’s administrator after taking action.
  9. sovereignty — a country’s authority over its own territory and affairs. Example: Accessing a server abroad can raise questions about another country’s sovereignty.

Speak for 60–90 seconds: A private company reports that customers have lost money in a cyberattack. It asks the government to stop a computer that may be helping the attacker. Explain why the reported losses matter, what officials still need to establish, and how they should consider the computer’s owner.
